Khrystina’s analytical and critical thinking skills help her navigate complex disputes and issues. Understanding that litigation demands often intersect with business considerations, she works closely with clients to build strategic solutions that meet clients’ needs.

Khrystina maintains a broad litigation practice with a focus on commercial litigation and class actions. Her previous experience at another leading commercial litigation boutique and the litigation department of a leading national firm includes complex corporate commercial disputes, regulatory investigations, insolvency matters, employment matters, professional negligence, class actions and competition litigation. Khrystina has appeared before administrative tribunals and all levels of court in Ontario. She has also represented clients in private mediations and commercial arbitrations.

Khrystina is the co-author of an article on solicitor-client privilege published in the Advocates’ Quarterly in 2015 and has authored numerous online articles on a variety of commercial and securities law topics. While at law school, Khrystina volunteered at a legal aid clinic representing injured workers in human rights and workers’ compensation claims.

  • Part of the legal team representing one of Canada’s top banks in successfully obtaining the dismissal of a multi-hundred million dollar claim for breach of representation and warranty in connection with the sale of a business.

  • Counsel to a tenant in a dispute with the landlord over damages for the tenant’s early termination of a commercial lease resulting in the sale of the property.
  • Counsel to a leading healthcare company engaged in disputes with a number of franchisees alleging breaches of the franchisor’s duty of good faith and fair dealings.
  • Counsel to a product distributor regarding a claim for product liability for allegedly supplying defective pipes and gaskets for a large Alberta water pipeline project.
  • Counsel to the Chief Financial Officer of an international technology company defending a putative class action alleging that the company and its officers failed to disclose allegedly material risks associated with financing agreements before the company’s insolvency.
  • Advised an international mining company regarding secondary market liability under the Securities Act for alleged misrepresentations in the company’s public disclosure for the company’s alleged environmental violations in a foreign country.
  • Advised an international company seeking to establish operations in a terra nullius (a territory that is not under the control and authority of any sovereign state).
  • Represented two individuals who successfully appealed a dismissal of their claim against their former lawyer for failing to secure the release of personal guarantees provided to an international financial institution in the acquisition of commercial property.
  • Representing a car dealership defending a claim for wrongful termination where the plaintiff’s employment was terminated for sexual harassment.
