LOLG Successful in Dismissal of Motion to Enjoin Powers of Sale
Overview
On March 14, 2025, the Ontario Superior Court of Justice released its decision in Condoman Developments v. Cannect International Mortgage, dismissing a motion for an injunction to prevent LOLG’s client, Cannect, from enforcing powers of sale under mortgages with respect to a debt owed to Cannect of more than $46 million. The Court agreed with LOLG that the Moving Parties had not made out any portion of the test for an injunction and held that there was no reason to stop Cannect from exercising its power of sale or pursuing its other remedies.
