LOLG Reaches Proposed Settlement in National Class Action Against Aviva

Overview

On March 9, 2026, the parties in Nordik Windows Inc et al v Aviva Insurance Company of Canada, CV-20-00643386-00CP, reached a proposed settlement of the certified national class action concerning business interruption coverage relating to COVID-19. Under the proposed settlement, Aviva has agreed to pay the all-inclusive amount of $150,000,000.00 in exchange for a release of all claims. LOLG is court-appointed class counsel, together with Thomson Rogers and Miller Thomson.
 
The Notice of Settlement Approval Hearing, which provides details regarding the proposed settlement that will come before the Ontario Superior Court for approval on October 13, 2026, can be found here. The claims process will not begin until the settlement is approved by the court.
