LOLG Obtains Mareva Order in Family Law Case Freezing Assets up to $20 million
Overview
In Montesano v. Montesano, Rahool Agarwal, Philip Underwood and Amethyst Haighton successfully obtained a Mareva order for their client, the Applicant, in furtherance of her family law application.
Justice Vella found that the Applicant had made out a strong prima facie case of entitlement to a significant equalization payment and that the Respondent’s conduct, which included breaching several court orders, dissipating his assets, fabricating net worth and income statements to suit his own needs, and forging the Applicant’s signature on documents, justified a Mareva order.
