Cross-Border Disputes

Many disputes that come to us have an international dimension, involving parties from different jurisdictions and subject matters that may cross borders. We have deep experience in private international law issues, including disputes over jurisdiction, forum selection clauses, arbitration, forum non conveniens and parallel proceedings, enforcing and resisting letters of request, service of process outside the jurisdiction, the application of foreign law, and the recognition and enforcement of foreign judgments and arbitral awards.

Our lawyers frequently act in litigation involving the coordination of proceedings in Canada with foreign proceedings. We have been involved in leading cases in this area, including the joint Ontario-Delaware trial in the Nortel insolvency proceedings, and in many class proceedings.
