Success On Defamation Claim Appeal

Rocco DiPucchio and Andrew Winton were successful before the Ontario Court of Appeal in an appeal from a decision of the Superior Court of Justice in which the motions judge struck a paragraph from a defamation claim. In its decision, the Court of Appeal agreed with the Plaintiffs that courts should apply a modern, flexible approach to the scrutiny of defamation pleadings and clarified how courts should resolve the tension between the need for particulars and the injustice of permitting defendants to escape liability for serious defamation.
