Daniel Schwartz and Larissa Moscu successfully defeated a plaintiff’s broad claims of privilege over relevant documents and obtained a production order of those documents. On November 18, 2016, the Ontario Superior Court of Justice sided with the defendants on their motion and found that the plaintiff had improperly resisted production of relevant documents on the basis of both solicitor-client and litigation privilege. Mr. Schwartz and Ms. Moscu were also successful in recovering a significant cost award for their clients. A copy of the decision is available here:decision-of-master-dash
