LOLG Successfully Obtains Injunction Against Departing Lawyers

On November 26, 2021, Justice Chalmers of the Superior Court granted an injunction against a group of lawyers who ‘conducted a planned and deliberate operation to take over’ the personal injury practice of their employer. In finding a ‘strong prima facie case the Defendants breached their good faith and fiduciary duties’, Justice Chalmers ordered the reimbursement of all disbursements and the placement of future settlement proceeds in trust pending an accounting.
