LOLG Secures Dismissal of Judicial Review Application Against York Region

On January 11, 2023, the Divisional Court dismissed an application for judicial review against York Region in connection with the award of a $500 million contract for the operation and maintenance of public transit bus services. The Divisional Court agreed with LOLG’s submissions on behalf of York Region, finding that the Region’s decision to award the contract was reasonable and that its decision-making process was fair. The decision contains a helpful analysis regarding the duties of a public authority in the competitive procurement context. Matthew Gottlieb, Rahool Agarwal, Philip Underwood, and Katelyn Johnstone acted for York Region on the application.
