LOLG awarded carriage of national class action against Aviva Insurance
Overview
On January 26, the Ontario Superior Court awarded LOLG, Thomson Rogers, and Miller Thomson carriage of a national class action against Aviva Insurance. The class action is brought on behalf of tens of thousands of Aviva business interruption policyholders whose claims for lost business as a result of Covid-19 were denied. The Court agreed these businesses need urgent relief and the case should proceed to certification and a determination on the merits as quickly as possible. The Court’s decision can be found here: Workman v. Aviva - Carriage Decision.
