In May 2022, Canada's Commissioner of Competition made an application to block Rogers' acquisition of Shaw over concerns that the deal will "substantially prevent or lessen competition in wireless services." Lax O’Sullivan successfully defended Rogers before the Competition Tribunal, which rejected the Commissioner of Competition’s challenge to the $26 billion acquisition of Shaw Communications Inc. by Rogers Communications Inc. in its entirety.

The Federal Court of Appeal dismissed the Commissioner’s appeal on January 24, 2023, and awarded costs against the commissioner in the amount of $13,000,000 on the basis of his ‘intransigent’ approach to the case.
