Counsel for B’Nai Fishel in defence of a claim and a Mareva injunction seeking damages of $55 million in connection with a failed agreement of purchase and sale for multi family real estate buildings. In February 2019, Justice Dow accepted the defendants arguments in respect of damages and limited the issuance of a world wide Mareva to just $690,000. A summary judgment motion is in the process of being scheduled. The matter is ongoing.
