Counsel to the plaintiffs in a claim against the plaintiffs’ former lawyers for breach of fiduciary duty and negligence.  The defendant lawyers sought to rely on the doctrine of absolute privilege to strike parts of the claim.  The plaintiffs successfully resisted the motions.  The Court of Appeal’s ruling provides a detailed review of the absolute privilege doctrine in Canada. 2013 ONCA 258
