Court Dismisses Motion To Strike Brought On Behalf Of REIT

Acting for the plaintiff, Shaun Laubman successfully argued against a motion to strike brought by Dream REIT in connection with a real estate transaction involving the sale of a portfolio of commercial properties. The REIT argued that the claims against it should be dismissed on the basis that it was not a party to the agreement of purchase and sale. The Court accepted the plaintiff's arguments and held that the statement of claim disclosed viable causes of action against the REIT. The decision can be found here.
