The British Columbia Court of Appeal upheld a trial judgment dismissing a $17 million claim for a breach of credit agreement.  On February 22, 2016, the British Columbia Court of Appeal released its decision upholding the BC Supreme Court’s trial judgment dismissing Maxam Opportunities’ claims for $17 million for breach of a $30 million credit agreement. The trial judgment considered and applied the law of implied terms, entire agreement clauses and contractual interpretation. The successful parties were represented by Jonathan Lisus, James Renihan and  Robert Cooper, Q.C.   The decision is available here:
